1. Service Description

WishingTunes ("the Service") is a platform that enables users to create personalized AI-powered wishes and artwork for special occasions including birthdays, weddings, festivals, and more. The Service uses artificial intelligence to compose unique musical compositions and visual artwork based on your inputs.

2. Account Creation

To use the Service, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (Google, Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 13 years old to create an account.

3. Wish Packs and Billing

WishingTunes uses a pay-per-wish model. You purchase Wish Packs and use them whenever you like. There are no subscriptions or monthly commitments.

• Welcome Wishes: 3 free wishes are granted on account creation, with no credit card required.
• Wish Packs: Purchase packs of 1, 10, 50, or 100 wishes. Larger packs offer a lower per-wish price.
• Referrals: Both you and the person you refer earn 3 bonus wishes when they sign up.

Wishes never expire. Payments are processed securely through Stripe. Refunds for unused wishes are handled on a case-by-case basis — contact [email protected].

4. Intellectual Property

Your Content: You retain all rights to the personal content you provide, including names, photos, and voice samples. By uploading content, you grant us a limited license to process it for the purpose of creating your wishes and artwork.

AI-Generated Output: Wishes and artwork generated by our AI systems are provided to you under a non-exclusive, worldwide license for personal, non-commercial use. You may share AI-generated content through the Service's sharing features. Commercial use of AI-generated content requires a separate license agreement.

Service IP: All trademarks, logos, software, and other intellectual property related to the Service remain the property of WishingTunes.

5. Content Guidelines

You agree not to use the Service to create content that is:

• Offensive, hateful, or discriminatory toward any individual or group.
• Sexually explicit or pornographic in nature.
• Threatening, harassing, or promoting violence.
• Infringing on the intellectual property rights of others.
• Fraudulent, misleading, or designed to deceive.
• In violation of any applicable laws or regulations.

We reserve the right to review, moderate, and remove content that violates these guidelines, and to suspend or terminate accounts that repeatedly violate these terms.

6. Acceptable Use

You agree not to:

• Attempt to reverse-engineer, decompile, or extract the AI models used by the Service.
• Use automated tools or bots to access the Service.
• Circumvent any technical measures or usage limits.
• Share your account credentials with others.
• Use the Service to train competing AI models.

7. Limitations of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that AI-generated content will meet your specific expectations or requirements. To the maximum extent permitted by law, WishingTunes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may terminate your account at any time by contacting us or through the account settings in the app. We may suspend or terminate your account if you violate these Terms of Service, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service will cease immediately. We will delete your personal data in accordance with our Privacy Policy.

9. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal resolution is not successful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to waive any right to participate in a class action lawsuit.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WishingTunes operates, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of that jurisdiction.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should discontinue use of the Service.
